These Terms of Service ("Terms") constitute a legal agreement between you ("you" or "user") and Calories X-Track ("we," "us," or "our") governing your use of the Calories X-Track mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Description of Service

Calories X-Track is a personal nutrition and fitness tracking application that allows you to:

  • Track daily calorie intake and macronutrient consumption
  • Log meals with nutritional details and photos
  • Monitor water intake
  • Record physical activities and calories burned
  • Track weight over time with trend charts
  • Set and manage personalized fitness goals

The App operates primarily offline, storing all data locally on your device.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should use the App only with parental or guardian consent.

4. User Responsibilities

When using the App, you agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Not attempt to reverse-engineer, decompile, or disassemble the App
  • Not use the App to transmit harmful or malicious content
  • Not interfere with or disrupt the App's functionality
  • Maintain the security of your device and data

5. Health and Medical Disclaimer

The App is not a medical device and does not provide medical advice. The calorie calculations, macro recommendations, and BMR estimates are based on general formulas and are intended for informational purposes only. They should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Always consult with a qualified healthcare professional before starting any diet, exercise program, or making changes to your nutritional habits. If you have any medical conditions, consult your physician before using the App.

6. Intellectual Property

All content, features, and functionality of the App — including but not limited to design, graphics, text, icons, and software — are the exclusive property of Calories X-Track and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy. You are responsible for maintaining the security and backup of your local data. We are not responsible for any data loss resulting from device failure, App uninstallation, or other causes beyond our control.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Calories X-Track shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes, or any other intangible losses, arising from your use of or inability to use the App.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Third-Party Services

The App may integrate with or contain links to third-party services (such as Google Play Store, Firebase, or analytics providers). These services are governed by their own terms and privacy policies. We are not responsible for the content, practices, or availability of third-party services.

10. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time without prior notice. We may also update these Terms from time to time. The updated Terms will be effective upon posting. Your continued use of the App after any changes constitutes acceptance of the revised Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, your right to use the App ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the appropriate courts of competent jurisdiction.
